Meeting Minutes

Regular Meeting

K. Metzler called the meeting to order at 7:38.

W2010-29 ~Eldredge Mills Road (Map 33 Lot 01 Map 33 Lot 04 & Map 34 Lot 12 Zone R80) Logging Application Owner: Richard Mihok Applicant: Hull Forest Products (Received November 8, 2010 Public Hearing by January 12, 20011 Decision within 35 days after close of P.H.)

Application was received.  The Commission held a brief discussion and will wait for Gary Jones’ report and hear from the applicant at the next meeting scheduled for 12/13/10.

W2010-30 10 Old South Willington Road (Map 18 Lot 36B Zone R80) Logging Application Owner: Richard & Michelle Burns Applicant: Hull Forest Products (Received November 8, 2010 Public Hearing by January 12, 2011 Decision within 35 days after close of P.H.)

Application was received and the Commission will wait for G. Jones’ report and hear from the applicant at the next meeting scheduled for 12/13/10.


Informal Discussion

Len Jacobs, Rick Shuffield, Rich Pettinelli request clarification of decision and to discuss future application. ~

Len Jacobs, Rick Shuffield, Rich Pettinelli and Josh Wilson were present.  Atty. Jacobs said they are looking for clarification on four paragraphs in the denial.  

Mr. Wilson said his question is on paragraph #4.  He said the method they used was the Ammann Methodology and Highway Methodology and the Commission said they did not account for the uniqueness of the site.  He asked for clarification.  

K. Metzler addressed this question.  He said in the Ammann Methodology there is a section on uniqueness and to provide information on endangered species.  He said there has been a lot published since that publication was made and he would like to see a more current evaluation using more current information.  K. Metzler said he received an informal request from the Conservation Commission for an Environmental Review Team to evaluate the site.  He said they cannot require this of the applicant but only suggest it.  K. Metzler said this would not cost the applicant and is provided by the State of Connecticut.

Mr. Pettinelli said his question is on paragraph #9 of the denial.  He said they tried to mimic the present flow of water on site and understand this paragraph has to do with ground water deprivation and the amount of pavement they want to bring in.  He said they could do a Gull-Wing and showed a central lower area pitching toward swales on plans. He explained the proposal and asked if the Commission would entertain this.  K. Metzler said they would have to refer this to their consulting engineer and asked Mr. Pettinelli to formulate his questions in writing.  

Atty. Jacobs said his question is on paragraph #17.  He said they all agree that nitrogen has to stop at the boundary.  He said, if they do a septic system design, it would cost about $20,000 and the Commission could deny the application.  Atty. Jacobs asked if they would consider approving the application subject to them brining back a septic system design subsequently.  He said they could provide the design in 2 steps.  K. Metzler said, if the applicant came back with an application, he would certainly hope they would do more testing to see if they could suitably contain the nitrogen.   He said this proposal would be possible if the applicant had approval from the Health Department and confidence they could design a septic system to contain the nitrogen. Mr. Pettinelli asked if it is more back-up documentation they are looking for and K. Metzler said yes.

Atty. Jacobs asked for more guidance in regards to paragraph #18 than the more general statements that were made.  K. Metzler said the way he reads it is they are very concerned about impacts to Roaring Brook and the capacity to maintain the pristine conditions of the water.  A brief discussion held.  T. Gutowski said there were 4 issues the town engineer raised and only 2 of the 4 were answered by the applicant.  A discussion was held on the number of times they took samples and the times of year.  K. Metzler said the reference to flood in #18 is in regards to a catastrophic event.  

T. Gutowski said her concerns are on paragraph #11 and #16.

Mr. Shuffield thanked the Commission for the amount of time they have put into this.  

Old Business

W2003-49 Notice of violation: TravelCenters of America (the Lessee) and George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road.

S. Yorgensen said she will follow up on this.

Minutes

D. Schreiber motioned to approve the minutes with the following modification; “phosphorus containt” should read “phosphorus content”.  T. Gutowski seconded the motion.  All in favor.

Discussion

A discussion was held on having a line item for Public Comment on the agenda.

A discussion was held on the engineer the Commission would like to use in the future.

A discussion was held on Roaring Brook.
